Regina v. Furet (2005) (Ont. Crt)
Mr. Furet, a young man stopped by Toronto Police while driving with some friends downtown and his trunk is subjected to a search by police. Police found a large quantity of marijuana and marijuana was purportedly packaged to be shipped to the United States in DVD cassettes. Ms Shemesh argued that the search was illegal and that the Police had not authority to stop the vehicle in the first place. Crown Attorney agreed and withdrew the charges against Mr. Furet.
Possession Charges and your Criminal Record
As a skilled drug lawyer, my goal is to fight drug possession charges and protect my clients' reputation. Conviction for possession charges means a criminal record. If faced with possession charges, you will need a skilled defense attorney to defend your case. I am a defense attorney who has successfully defended many possession charges.
As your drug lawyer, I can defend you using tactics such as negating the evidence obtained by an unreasonable search. Through my experience as a defense attorney, I know that Canadian law protects all individuals from unreasonable searches where a police officer performs a property search which was not authorized by the law. An officer must be acting within the power of a valid statute. Without reasonable and probable grounds that a crime has been committed, an officer may not attempt a search.
In the case of Mr. Furet, the officers in question did not have the authority to pull Mr. Furet over much, less search his vehicle. Any evidence acquired and used as a basis to charge Mr. Furet with possession charges was not credible and ultimately these charges would not affect his criminal record.
