Criminal Defense Attorney Defending Alleged Sex Crimes

Regina v. A.A., [2006] O.J. No. 3522 – (Ont. Crt)

Client is charged with sexually assaulting a 16 year old co-worker. Ms. Shemesh cross examined the complainant vigorously in order to prove that the sexual touching was consensual and that the two had engaged in petting during the course of the evening. Ms. Shemesh displayed the inconsistencies in the complainant’s evidence such that his honor found the following:

I find that there was mutual sexual touching between Ms Y.R. and Mr. A.A. which led him to believe that he could touch her the way she was touching him and that was a reasonable assumption on his part to make. He also believed that she was interested in him and reasonably assumed that he could kiss her. I reject her evidence that he touched her breast and her vaginal area.
